Terms of passenger car rental by Chayka Rental. The final terms are set out in the contract when the car is handed over. This is a courtesy translation; the Russian version prevails.
1. General provisions
This document is a public offer of the limited liability company “Mertelecom”, UNP 692073506 (the “Lessor”), and contains the terms of a passenger car rental contract with any individual (the “Lessee”) who accepts these terms.
The information on the chayka.by site (car descriptions, prices, terms) is for information only. The final terms are set out in the rental contract signed when the car is handed over.
2. Subject
The Lessor transfers to the Lessee for temporary possession and use, for a fee, a passenger car without a crew, and the Lessee undertakes to pay for the rental and return the car by the set date in proper condition.
3. Conclusion of the contract
- The Lessee chooses a car and period on the site, by phone or in a messenger and sends a request.
- The Lessor confirms car availability, price and terms.
- The contract is considered concluded from the moment the rental contract and the vehicle acceptance certificate are signed at handover.
4. Requirements for the Lessee
- age of 23 or older and at least 2 years of driving experience;
- a valid driving licence and an identity document;
- only persons named in the contract may drive the car.
5. Price, payment and deposit
The rental price is shown on the site in Belarusian roubles per day and depends on the model and rental period: the longer the period, the lower the daily price. Extra services (car delivery, travel abroad and others) are paid separately at the rates on the site.
To secure performance of obligations the Lessee pays a deposit: for citizens of the Republic of Belarus – 200 BYN, for foreign citizens – 300 BYN (for some cars the deposit may differ; it is shown on the car page and in the contract). The deposit is returned when the car is returned in the same condition, less any amounts to be withheld under the contract.
6. Rights and obligations of the Lessee
- to use the car in accordance with its purpose and the traffic rules;
- to pay for the rental and extra services on time;
- not to pass the car to third parties or use it for towing, driving lessons or competitions;
- to observe the mileage terms and return the car with the same fuel level as at handover, unless the contract says otherwise;
- to leave the Republic of Belarus only by agreement with the Lessor and with the necessary documents;
- to inform the Lessor immediately of an accident, breakdown, theft or damage to the car.
7. Rights and obligations of the Lessor
- to hand over a car in working order, clean, with the necessary documents;
- to provide information about the terms of use of the car;
- to demand return of the car on time and in proper condition;
- to terminate the contract and demand return of the car in case of a material breach of the terms by the Lessee.
8. Liability
The Lessee is liable for damage to or loss of the car in the cases and amounts set by the contract and legislation. Administrative fines and other payments arising during the rental (including for traffic violations, parking and toll roads) are paid by the Lessee.
The Lessor is not liable for items left in the car or for delays caused by force majeure.
9. Extension, return and termination
The rental may be extended by agreement with the Lessor if a car is available. Late return is paid at the rental rate and may entail a penalty provided for by the contract. Early return and cancellation of a booking are carried out on the terms set out in the contract.
10. Personal data
The Lessee agrees to the processing of personal data in accordance with the Privacy policy.
11. Dispute resolution
Disputes are resolved through negotiation. If agreement is not reached, they are resolved in court under the legislation of the Republic of Belarus.
