Copyright and use of materials

Copying the texts, photos, design and code of the site without written consent is prohibited.

1. What is protected

All materials of the chayka.by website (the “site”) are protected by the laws of the Republic of Belarus on copyright and related rights and on trademarks. These include:

  • texts, car descriptions, blog articles, terms, rates and answers to questions;
  • photographs, videos and images, including photos of cars and the office;
  • design, layout, structure and source code of the site, page and interface styling;
  • the “Chayka Rental” name and logo, brand style, compilations and databases (car catalogue, rates, reviews).

2. Rights holder

Exclusive rights to the site materials belong to the limited liability company “Mertelecom” (UNP 692073506) or are used on lawful grounds. Customer reviews and photos are published with their consent and remain the property of their authors.

3. What is prohibited without written consent

  • copying, reproducing, adapting or distributing site materials in whole or in part;
  • publishing them on other websites, social networks, messengers, classified boards and marketplaces, including as your own;
  • using our photos, texts, logo and name in your advertising, on copy-cat sites, in listings or in other companies’ profiles;
  • creating copies of the site, its pages or sections, or look-alike sites that mislead users;
  • using names, logos or designations confusingly similar to “Chayka Rental”;
  • automated collection of site data (parsing, scraping) and using the materials to train neural networks or databases without permission.

4. What is allowed

  • browsing the site and using the information for personal non-commercial purposes, for example to choose and rent a car;
  • quoting short fragments with attribution and an active link to https://chayka.by;
  • sharing links to site pages.

Any other use requires the prior written consent of the rights holder.

5. Liability for infringement

In case of infringement we may demand that the use stops and the materials are removed, file complaints with the platform owner, hosting provider, search engines and social networks, record the infringement and go to court. Depending on the circumstances, the infringer may bear civil liability (compensation for losses or statutory compensation), as well as administrative and criminal liability in cases provided by the laws of the Republic of Belarus.

6. How to get permission or report infringement

1. General provisions

This policy sets out how personal data of users of the chayka.by website (the “site”) is processed and protected. Personal data operator: limited liability company “Mertelecom”, UNP 692073506, address: Minsk district, village of Leskovka, 3 Sovkhoznaya St., office 20 (the “Operator”).

The policy has been drawn up in accordance with the Law of the Republic of Belarus of 7 May 2021 No. 99-Z “On Personal Data Protection” and other legislation of the Republic of Belarus.

By sending a request on the site or contacting us through the channels listed on the site, you confirm that you have read this policy and consent to the processing of personal data on the terms described below.

2. What data we process

  • name;
  • phone number;
  • message and selected rental parameters: car, dates, extra services, driver citizenship;
  • technical data: IP address, device and browser type, pages you visited, cookie data.

We do not ask for passport, driving licence or bank card details on the site. These documents are presented in person when the rental contract is signed.

3. Purposes of processing

  • processing your request and contacting you to confirm the booking, price and car availability;
  • preparing and performing the rental contract;
  • answering your questions;
  • improving the site and analysing traffic;
  • complying with legal requirements.

4. Legal grounds

Processing is carried out on the basis of your consent, and in cases where it is necessary to conclude and perform a contract to which you are a party and to fulfil obligations imposed on the Operator by law.

5. Transfer of data to third parties

Data is not sold or passed to third parties for advertising purposes. To run the site and process requests we use hosting and messaging services (including Vercel and Telegram), which may be located outside the Republic of Belarus. Transfer is carried out to the extent necessary for the service to work.

Data may be provided to public authorities in the cases and in the manner provided by law.

6. Retention period

Data is stored no longer than necessary for the purposes of processing: requests – until the enquiry is handled and the contract performed, then for the periods set by law. After that the data is deleted or anonymised.

7. Cookies and analytics

The site may use cookies and web analytics services to understand how visitors use the site. You can disable cookies in your browser settings, but some site features may not work correctly.

8. Your rights

  • to obtain information about the processing of your data;
  • to demand correction of inaccurate data;
  • to withdraw your consent to processing;
  • to demand that processing stop and the data be deleted if there are no other grounds for processing;
  • to appeal against the Operator's actions to the authorised body for the protection of the rights of data subjects (the National Personal Data Protection Centre of the Republic of Belarus) or to a court.

9. Data protection

We take legal, organisational and technical measures to protect data from unauthorised access, alteration, disclosure and destruction. Data between your browser and the site is transferred over a secure connection (HTTPS).

10. Changes to the policy and contacts

We may update the policy. The current version is always posted on this page, and the revision date is shown at the top.
